Sec. 6.1000. Foothills Overlay (F-0) Zone.

Sec. 6.1001. Purpose.

The Foothills Overlay (F-0) zoning district provides a means to recognize and further preserve the rural desert character in the low density un-subdivided and undeveloped lands (at the time of the adoption of this ordinance) to which the F-0 overlay district has been applied by defining additional standards that help to define the area's unique character while causing minimum visual impact and enforcing the purposes of the Environmentally Sensitive Land Ordinance (ESLO) as ti relates to blending the built form into the desert environment.

Sec. 6.1002. Applicability.

The Foothills Overlay (F-0) district may be overlaid upon the following zoning districts: 

 Rl -43, Rl -70, Rl -130, Rl -190 and COS, HC and OS and may be combined with the ESL and HP overlay districts.

Sec. 6.1003. Use regulations.

A. Permitted uses. Any use permitted in the underlying zoning district.

B. Uses permitted by conditional use permit. Any use permitted by conditional use permit in the underlying zoning district, however any such uses are subject to meeting all the requirements stated in this overlay in order to be compatible with neighboring properties and this character district. Height exceptions allowed in Article VII of the zoning code shall not be allowed except by variance.

Sec. 6.1004. Property Development Standards.

The property development standards, of the underlying district shall apply except as modified below.

A. Required yards

The definition of required yards for various lot sizes are:

Note: These are the current values, specified in the zoning ordinance, for the given lot sizes. Used herein, they are lines drawn parallel to the lot line for the entire length, width, or depth of a lot and as such represent building setbacks from the property line. Unless stated otherwise, no portion of any building shall be located in these required yards, or located any closer to the property line than the value given for the required yard setback.

B. Building Height.

1. Buildings in general., No building of any type or for any use shall exceed twenty-four (24) feet in height, including all parts or appurtenances of the building. In addition, not more than thirty percent (30%) of the building shall exceed a height of twenty (20) feet

2. Accessory Buildings, Accessory buildings shall be no higher than 16 feet.

C. Walls, Fences and Hedges:

1. Walls, fences, or hedges no taller than three (3) feet in height are allowed anywhere on the property, however an average setback of 5 feet from the property line shall be maintained. The use of undulating walls that follow the land form are highly encouraged.

2. Walls, fences or hedges taller than three (3) feet in height may not be placed within a required front yard.

3. The maximum portion of a parcel that may be enclosed by solid walls, fences and hedges taller than three (3) feet in height but not taller than six (6) feet in height shall be as follows-

Parcel size: maximum enclosure area by walls and building (including the area of any accessory building).

32,000 to 69,999 sq. ft. 60% of net lot area
70,000 or more 60% of net lot area for the first 70,000 sq. ft. of. lot area then 45% of net lot area for any additional lot area

4. Exceptions:

a. No wall, fence or hedge may be placed in a location that separates a natural area open space (NAOS) from an adjacent street right-of-way or road/access easement or an adjacent natural area open space (NAOS).

b. Walls, fences or hedges up to eight (8) feet tall may be placed along Collector and Arterial streets provided that the wall is at least fifty (50) feet from the right-of-way. If the street is a scenic corridor, the fence shall be setback at least 150 feet from the Right-of-way. The maximum distance that an eight (8) foot fence will be allowed is 150 feet for Collectors and Arterials and 250 feet for scenic corridors.

c. A corral fence not exceeding six (6) feet in height shall be permitted on the property line or within any yard- except that no corral fence may be placed within ten (10) feet of a street right-of-way or a dedicated public trail easement or pathway easement. Areas enclosed by a corral fence are not subject to the provisions of section 6.1004.B.3. A corral fence is defined as a fence having at least 75% of the area of the fence open (minimal visual impact).

D. Accessory Buildings:

1. The main building, in the residential zoning districts R1-35, R1-43, R1-70, R1-130, and R1-190, is defined as the primary residence. No accessory building can be considered as main building.

2. No portion of any accessory building shall be located within any portion of the required front, side, and rear yards as defined in section 6.1004 A.

3. The minimum distance between an accessory building located within the portion of the property excluding the required front, required side or required rear yards and any other building on the same parcel shall be:

4. The total maximum coverage of accessory buildings, for R1-43 lot sizes, shall be thirty (30%) percent of the area remaining after required front, side, and rear yards and NAOS is subtracted from the parcel/lot area. For other lot sizes the percentage shall be reduced to result in the maximum building areas specified below.

5. The maximum size of any one accessory building shall be:

E. Large Building Setbacks: The minimum setback for any building of 6,000 square feet (under roof) or more shall be the larger of the required yard or the values given below:

F. Outdoor Lighting:

1 . All exterior lighting below 3 feet in height shall be fully shielded. All exterior lighting above 3 feet in height shall consist of horizontal full-cutoff fixtures and directed downward.

2. Lights enclosed within a building, but visible from the property line, shall also have to meet the requirement in 1 above.

3. All exterior lights including building mounted and on poles shall not exceed a height of fifteen (15) feet.

4. Exemption: Lights that are connected to a delay switch that do not stay on more than 15 minutes for security purposes shall not be required to be shielded or contain horizontal cutoffs.

G. Sensitive Building Design, Site Planning, and Integration:

The following goals, as stated in the Environmentally Sensitive Land Ordinance, shall be strictly adhered to in this overlay.

1) Conserve the character of the natural desert landscape. The desert is an important tourist attraction which contributes to Scottsdale's economy.

2) Minimize the impacts of development by controlling the location, intensity, pattern, design, construction techniques, and materials of development and construction.

3) Retain the visual character of the natural landscape to the greatest extent feasible by regulating building mass, location, colors, and materials; grading location, design and treatment; and landscaping design and materials.

4) Maintain significant open spaces which provide view corridors and land use buffers, protect landmarks and prime wash habitats, and maintain the city's unique desert setting.

5) Protect environmentally sensitive lands, while also recognizing the legitimate expectations of property owners, and the city's overall economic goals.

6) Encourage innovative planning, design and construction techniques for development in environmentally sensitive areas.

In addition to these goals and guidelines, the following specific guidelines shall apply in this overlay.

1. Reflective building materials are prohibited.

2. No paint colors shall be used which have a light reflective value (LRV) greater than thirty (30) percent.

3. Exterior paint and material colors shall not exceed a value of four (4) as indicated in the Munsell Book of Color on file in the Planning Systems Department.

4. Plant materials that are not indigenous to the area shall be limited to 4. enclosed yards and shall not exceed twenty (20) feet in height. A list of indigenous plants is available form the Planning Systems Department. Outdoor community recreation facilities, if allowed in the area covered by this overlay, shall be allowed turf as specified in section 7.854 (E) (2) (e).

5. Turf shall be limited to enclosed areas not visible off-site from lower elevation. Outdoor recreation facilities, if allowed in the area covered by this overlay, including parks and golf courses, shall be exempt from this standard.

6. Any paved parking or staging areas located on any parcel shall be suitably screened from the street, and from neighboring properties, with vegetation buffers and shall utilize colored materials that blend in with the desert environment.

7. Collector and local roads within this district shall retain their desert rural character by leaving them unpaved wherever possible. Where dust control is necessary, the surface may treated with materials that retain the look of the unpaved surface as much as possible. When a trail is to be provided along a road alignment, the road/trail profile shall provide for a buffer of at least 15 feet between the road and the trail.

8. City applied amenities (signage, railings, bridges, etc.) shall reflect a rural western character as defined by the working group and city staff. As a minimum, these amenities shall meet the lighting and building design and integration requirements stated above. In addition, the city shall coordinate with utility companies to insure that utility installations comply with all the requirements stated in this overlay as much as feasibly possible.
